The trademark registrations for Trump brands are for, amongst other things, clothing, alcoholic beverages, furniture, a casino, and real estate services. The registrations held by DTTM Operations, which safeguards the commercial interests of the President, were challenged by the Luxembourg company Anthee.

 

WINE AND WHISKY

During the proceedings, the Trump organisation filed documents that needed to prove that the trademark name Trump was also used in Europe for items such as alcoholic beverages and clothing. The evidence that Trump brought forward, however, was very scanty. As EUIPO ruled: if selling two bottles of Trump wine and six bottles of Trump whisky over a period of five years is all you have to show for, you can hardly speak of a “normal use” of the Trump trademark.

ONLY GOLF RESORTS

For clothing, real estate services, and the casino, Trump was equally unable to show any evidence of use in Europe. He did succeed in providing the required evidence for his golf activities and hotels. In Scotland and Ireland, the trademark Trump is consistently used for the golf resorts. So consequently, these are the only activities for which the protection of the name Trump will be upheld.
